These Terms of Service (“Terms”) form a legally binding agreement between you and PlusMinusOne, the operator of Melda (“Melda,” “Company,” “we,” “us,” or “our”), with its principal place of business at:

These Terms govern your access to and use of the Melda mobile application and related services (collectively, the “Service”).

By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

Your use of the Service is also governed by our Privacy Policy. Please review it carefully.

1. What Melda Is

Melda is a menstrual cycle tracking and AI-powered companion application designed to help you understand patterns related to your cycle, symptoms, mood, and wellbeing.

Melda is a self-management tool. The quality and accuracy of predictions and insights depend on the information you choose to provide.

We may update, modify, improve, or discontinue features of the Service at any time.

2. Not Medical Advice

Melda is not a medical device and does not provide medical advice.

The Company is not a licensed healthcare provider. The Service, including AI-generated responses, predictions, cycle estimates, and recommendations, is provided for informational and supportive purposes only. It is not intended to diagnose, treat, cure, or prevent any medical condition.

Always seek the advice of a qualified healthcare professional regarding any medical concerns. If you believe you are experiencing a medical emergency, contact emergency services immediately.

Melda does not provide crisis intervention services and is not a substitute for emergency mental health support. If you are experiencing a mental health crisis, suicidal thoughts, or believe you may be in danger, contact your local emergency services immediately.

Your use of the Service is at your own risk.

3. Eligibility and Minimum Age

Minimum Age Requirement: 13 years old (or the minimum age required in your country of residence, if higher).

You must be at least 13 years old, or the minimum age required in your country of residence, whichever is higher, to use the Service.

If you are below the age of majority in your jurisdiction but meet the Minimum Age requirement, you may use the Service only with the consent and supervision of a parent or legal guardian where required by applicable law.

By using the Service, you represent and warrant that you meet the applicable Minimum Age requirement and have the legal capacity to enter into this agreement.

We reserve the right to suspend or terminate access if we reasonably believe a user does not meet the Minimum Age requirement.

4. No Account Required; Device-Based Identifier

Melda does not require account creation, registration, or login.

When you install the app, a random unique identifier is generated and securely stored on your device using Apple’s Keychain technology. This device-based identifier allows us to associate data with your device and provide continuity of service.

Health and usage data are stored on secure cloud servers and associated with this device-based identifier rather than a traditional account.

If you delete and reinstall the app on the same device, your device-based identifier may allow restoration of your previously stored data.

Deleting the application from your device does not automatically delete your data from our cloud servers. If you wish to permanently delete your data, you must submit a verified deletion request in accordance with Section 12 below.

5. AI-Generated Content

Melda includes AI-generated conversational responses and insights. These responses are generated automatically based on the information you provide and may be inaccurate, incomplete, or inappropriate.

AI outputs are probabilistic in nature and are not reviewed by medical professionals. The Company does not guarantee the accuracy, reliability, or suitability of AI-generated content.

AI inputs may be temporarily stored by our processors for abuse monitoring, safety review, fraud prevention, and system reliability purposes. Such inputs are processed strictly on our behalf and are not used to train generalized or external AI models.

You agree not to rely on AI-generated responses for medical, legal, financial, or other professional decisions.

6. Subscriptions and Billing

Certain features of the Service may require a paid subscription (“Paid Services”). Paid Services may be offered through the Apple App Store and/or through our website. Prices, billing frequency, and what’s included will be shown to you before purchase.

6.1 App Store Purchases (Apple)

If you purchase a subscription through the Apple App Store:

Deleting the application from your device does not cancel your subscription and does not delete your stored data.

Payments for subscriptions purchased through the Apple App Store are processed by Apple. Refund requests must be submitted directly to Apple and are subject to Apple’s refund policies and procedures. Except as required by applicable law, subscription fees are non-refundable. Where mandatory consumer protection laws provide a right of withdrawal or refund, those rights remain unaffected.

6.2 Web Purchases (Web2Web) and Stripe

Melda may allow you to purchase Paid Services through our website (a “Web Purchase”) and then use those Paid Services in the Melda app (a “web-to-web” or “web2web” purchase). If you make a Web Purchase, you may be required to provide an email address and payment information for billing, receipts, fraud prevention, customer support, and subscription management. Your email address is used for purchase administration and does not create an in-app account.

For Web Purchases, payments are processed by Stripe as our payment processor. Unless otherwise disclosed at checkout, PlusMinusOne is the seller and merchant of record for Web Purchases, and Stripe processes payments on our behalf. We do not store your full payment card details; Stripe handles payment processing in accordance with its terms and policies.

Web subscriptions may be offered on a recurring basis (for example, monthly or yearly) and will automatically renew unless canceled before the renewal date. By purchasing a web subscription, you authorize PlusMinusOne (through Stripe) to charge your selected payment method on a recurring basis at the then-current subscription price, plus any applicable taxes, until you cancel.

To cancel a Web Purchase subscription, follow the instructions provided in your purchase confirmation email or contact us at support@melda.ai. Cancellation takes effect at the end of the then-current billing period unless required otherwise by applicable law. Deleting the app does not cancel a web subscription.

Refunds for Web Purchases are handled in accordance with applicable law and any refund terms shown to you at checkout. Some jurisdictions (including the European Union and the United Kingdom) provide mandatory consumer protections, including potential withdrawal (“cooling-off”) rights for online purchases. Where required, we will provide any legally mandated information at checkout. If you request immediate access to digital services after purchase, you may be asked to acknowledge that you may lose or waive certain statutory withdrawal rights to the extent permitted by applicable law.

6.3 Price Changes

We may modify subscription pricing from time to time. Price changes will apply at the start of the next billing period (or as otherwise required by the relevant platform or applicable law). If you do not agree to a price change, you may cancel your subscription before the new price takes effect.

7. Your Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms.

You may not:

8. Intellectual Property

All content, software, designs, text, graphics, AI systems, and materials associated with the Service are owned by the Company or its licensors and protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

9. Third-Party Services

The Service may integrate with or link to third-party services, including the Apple App Store.

We do not control third-party services and are not responsible for their content or practices. Your use of such services is subject to their terms.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available.”

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted operation or error-free functionality.

11. Limitation of Liability

To the maximum extent permitted by law, the Company and its affiliates shall not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the Service.

Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim, or one hundred U.S. dollars if no payment was made.

Nothing in these Terms excludes liability where such exclusion is prohibited by law.

12. Data Retention and Deletion

Your data is stored on secure cloud servers and associated with a device-based identifier.

Deleting the application from your device does not automatically delete your data from our servers.

If you wish to permanently delete your data, you must submit a verified deletion request using the “Delete My Data” feature within the app or by contacting us at support@melda.ai. Upon verification, we will permanently delete your personal data from our active systems within 30 days, unless retention is required by law.

We may request reasonable information to verify that the deletion request is associated with the correct device identifier and to prevent unauthorized deletion of another user’s data.

13. Termination

You may stop using the Service at any time.

We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Service.

Provisions relating to intellectual property, disclaimers, limitations of liability, and dispute resolution survive termination.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

For users residing in the United States, any dispute arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration under the rules of the American Arbitration Association. You waive any right to participate in a class action or jury trial.

If you reside in the European Union or the United Kingdom, mandatory consumer protection laws of your country of residence apply and may provide additional rights. Nothing in these Terms limits or excludes rights that cannot be waived under applicable law. You may bring claims before the courts of your country of residence where required by law.

You may opt out of arbitration (where applicable) within 30 days of first accepting these Terms by providing written notice to support@melda.ai.

15. Apple-Specific Terms

If you downloaded the Service from the Apple App Store, you acknowledge that this agreement is between you and the Company, not Apple Inc.

Apple is not responsible for the Service and has no obligation to provide maintenance or support. Apple is a third-party beneficiary of these Terms and may enforce them against you.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you within the app or update the “Last Updated” date above.

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

17. Data Sharing for App Store Refund Processing

By using Melda and accepting these Terms, you acknowledge and agree that we may share certain usage and consumption data with Apple Inc. to assist in processing and evaluating App Store refund requests. This information may be transmitted through our service provider, RevenueCat. This consent is specific to refund request processing and is separate from any other data collection or sharing practices.

When a refund request is made through the App Store, we may share the following information with Apple:
